A Farmington man is facing a charge of felony animal abuse for allegedly killing his daughter's 3-month-old kitten by kicking it and throwing it against a tree.
A criminal complaint filed on Sept 11 in Waupaca County Circuit Court charges Richard P. Basina, 39, N3020 Otter Drive, with one count of mistreatment of animals causing death. A warrant was issued for his arrest.
The charge carries a maximum penalty of 18 months in prison and two years of extended supervision.
According to the criminal complaint, on the night of Aug. 2, Basina became angry because the kitten had urinated in his 16-year-old daughter's bedroom.
According to the daughter, Basina took the calico cat, named Kallie, and threw it against a tree, killing it.
Police asked Basina what happened and he said he had consumed about 12 to 15 beers and was upset because the cat had made a mess in the bedroom.
He said he kicked the cat down the stairs. The cat was unable to get up because it apparently suffered a broken leg. He said he took the cat outside and threw it against a tree. The cat then ran away.
According to Basina's son, Basina said he had taken the cat outside and broken each of its legs. He allegedly threw the cat against a tree several times until it was dead. He told his son he buried the cat on the property.
Case Updates| Richard P. Basina was found guilty of intentional mistreatment of animals, a class A misdemeanor, on February 9, 2007. The felony charge was dismissed. Basina was sentenced to 30 days in jail, one year of probation, and a fine of $373.04.
