On March 24, 2006, Jose Alfredo Martinez, Jr. was convicted of 3 counts of animal cruelty in Desert Hot Springs, CA. In August 2005, animal control officers seized three German shepherd mix dogs that were tethered outside to a gas meter without water or shelter in 105 degree weather. All three dogs were reportedly emaciated. A 29 inch male weighed in at just 40 pounds, a 26 inch female weighed 42 pounds and an 8 month old puppy that was 24 inches tall weighed only 20 pounds.
Martinez was ordered to spend 1 day in custody, pay a $230 fine, restitution to the city of Desert Hot Springs for $11,148. He was also ordered to surrender all animals to the city, and was sentenced to 3 years probation, during which time he is prohibited from owning any animals. During the period of probation, animal control is permitted the right to immediate search (limited to cats and dogs), with or without probable cause.
