A 38-year-old Pleasant Grove man will be arraigned Dec. 27, 2005, on 10 felony charges of animal cruelty involving 10 horses, one of which had to be euthanized, according to Sutter County prosecutors.

Superior Court Judge H. Ted Hansen bound Daniel Shawn Burke over for trial after hearing 13 witnesses during a preliminary hearing. Some said horses they sold to Burke suffered drastic weight loss in about five months.

Burke allegedly failed to provide proper food and shelter to the animals at a ranch in the 6200 block of Pleasant Grove Road, said Deputy District Attorney Amanda Hopper. Sutter Animal Control Services intervened in February 2005 after fellow horse owners complained. Sheriff's deputies patrolling the area also noticed the animals' poor condition, said Hopper.

Horse owner Kathleen Ades testified she sold two horses to Burke in September 2004 - an Arabian gelding named Tiger and Mattie, a mare. Both animals were in �very good condition,� said Ades. When she saw the animals the following February, both were emaciated, with ribs showing, she said.

Another mare, Babs, was so emaciated and weak that it could not stand. The horse was �everything but dead,� said Ades.

Animal Control Services seized four of the horses and gave others away to owners who testified that the animals recovered after receiving proper care. Veterinarian Susan Gillen testified that one horse gained 250 pounds in 45 days after being rescued.

Hansen threatened to have Burke arrested if he fails to show up on time for the Dec. 27, 2005 arraignment. Burke failed to show up for a hearing December 7, 2005 and was 40 minutes late to a preliminary hearing on December 8, 2005, said Hansen.

Burke is facing a maximum three-year prison sentence in the case of the horse that died, said Assistant District Attorney Fred Schroeder.
