Humberto Jose Gutierrez Jr., the man accused of chasing Canada geese with his vehicle in Rothwell Park and killing one in the process was charged with felony driving while revoked. Assistant Prosecuting Attorney Brad Crowell said that the charges for the killing of the goose will come once the case is bound over to Circuit Court.
"The goose charges are coming, but everything will be filed in Associate Court first and then we will add the misdemeanor charges once it reaches the Circuit Court," Crowell said. A felony driving while revoked can mean up to four years in prison for Gutierrez Jr. and/or a $5,000 fine. The misdemeanor charge will be an animal abuse charge, Crowell said.
In early July he was seen running down geese with his car near the dam on Water Works Lake in Rothwell Park. Investigations by Missouri Conservation Agent Jeff Brown and the Moberly Police Department indicated Gutierrez was responsible.
"At the time he was running down the geese with his car, he was driving while revoked and those are felony charges because of his past convictions," he said. Gutierrez was found guilty of resisting arrest in May of 2003, leaving the scene of a motor vehicle accident in June of the same year. Last May he received a driving while intoxicated charge.
Officials with the Missouri Conservation Department in Jefferson City said there are a few cases every year where people purposefully or accidentally hit geese. According to the Conservation Department, the Canada goose is a federally protected species. References |
