Jeffrey Hackbarth, 43, was arrested by Torrington police on the evening of July 15 after police found Hackbarth�s dog had hung itself on a chain after it fell from a third-floor porch.

Harbarth lived on the third floor of the multi-family house on 232 Park Ave., according to a police report. The fire department retrieved the animal�s body, according to a police report.

Hackbarth cried during a brief court appearance before Judge Dan Shaban.

"We nolled the case because it appeared to be an accident," Supervisory Assistant State�s Attorney Andrew Wittstein said. A nolle allows the prosecutor to reopen a case within 13 months, but after that period the charge is dismissed.

The death of the animal was tragic, but is considered an accident, the prosecutor said.

"The dog went over the barrier of the porch, and how it got up there is unknown," Wittstein said. "There were some folding chairs that appeared to have been knocked over, and the dog managed to get on the roof and slipped, hanging itself on the chain."

Wittstein said Hackbarth told police he left water out for the animal. The water may have been knocked over during the incident, police said.
