Jonathan H. Gardner, 44, of Demeritt Ave in Lee was charged with two counts of cruelty to animals after police found one dog with softball size mass on the side of its head and another dog losing its fur due to a bacterial infection.

Gardner pleaded innocent to the two charges of cruelty to animals plus three counts of failure to license a dog as prescribed by law and three counts of failure to obtain rabies vacinnations.

When Officer Natasha Richard responded to two animals running at large, she found a Rottweiler named Joshua, and a Rottweiler-mix named Aja.

Joshua's head wound almost forced its eye closed. It was later determined that Joshua's head wound was caused by a ruptured eardrum that went untreated causing it to become infected.

After being taken to the Oyster River Veterinary Clinic Joshua had to have emergency surgery for the mass on his head and that's when they discovered he had a ruptured eardrum from a blow to the head. Police have not found out who caused the blow to the dog's head. It had been too long since the blow was dealt to determine what had been used to hit the dog in the head.

Aja was also found to be in very poor condition. The dog was very thin, had spots of hair missing and the dog's hip bones were protruding and it has having difficultly standing and walking.

Local veterinarians had been checked and it was determined the dogs had not been to a veterinarian in the past four years.

Sandra Rainy, animal cruelty investigator, Richard and Moreen Dexter, Humane Society Manager, went back to Gardner's house and after looking at the animals' living conditions placed both animals in protective custody.

Aja's kennel at the Gardner's residence had a large amount of feces, which probably caused the bacterial infection. Aja also needed surgery for hip dysplasia, a genetic condition. Gardner was charged with neglect because of the severity of the condition and his failure to have the dog treated.
