Joshua Summers, 20, of Newark has been sentenced to five days in jail for repeatedly kicking a stray cat that was in his care.
Summers is slated to be released from jail Wednesday after serving sentence on a misdemeanor charge of cruelty to animals, according to court records.
Summers "swears up and down that he did not" kick the cat several times in early October 2003 at his residence, but two neighbors claimed he did, according to Newark City Dog Warden Toby Wills and records from the Licking County Municipal Court.
Wills said he found "blood still on the door, couch and floor" of Summers' apartment when he went to investigate the complaint.
Summers told authorities he was taking care of a stray black-and-white cat and admitted to throwing the cat down after it scratched him, records stated. Summers wrote in his statement to Newark police that he would never intentionally hurt an animal.
One witness, Frank R. Jaros, told authorities he heard what sounded like a baby crying and saw Summers kicking the cat.
"He was opening the door so the cat would try to get out. When it would try, he (would) shut the door and would drop kick it," a witness wrote in his statement to Newark police.
Judge Michael Higgins fined Summers $100, placed him on one-year probation and suspended 55 days of a 60 day jail sentence, according to court records.
Summers, who originally plead innocent, changed his plea to guilty and was sentenced in March 2004.
