A Regina man accused of using a vehicle to try to hit two people is also facing an animal cruelty charge for allegedly running over and fatally injuring a dog Friday evening.

According to information from the Regina Police Service, officers were called at about 6:15 p.m. Friday to the 3200 block of Patricia Avenue after receiving a complaint about a threat being made there.

Police spoke to the home's residents who described a situation that began when two males pulled up in front of the house in a white car.

The passenger from the car -- whose identity is unknown at this point -- got out and went to the front door, where he apparently confronted the 46-year-old male resident of the house. During the confrontation, a threat was allegedly made.

The unknown man then started back towards the vehicle.

At that point, the resident's dog, a female Rottweiler, got out of the house. The resident ran after both the dog and the unknown male, who by now had gotten back into the vehicle.

"It's alleged that the driver of the vehicle swerved toward the male resident and a neighbour and attempted to strike them with the vehicle, and then it's alleged that the driver swerved and ran over the dog belonging to the male who allegedly was threatened . . . ," said city police spokeswoman Elizabeth Popowich on Monday.

"It seems the parties are known to each other and I think the origin of the disagreement (is) not really clear at this stage."

The vehicle left after that and the home's resident took his dog to the vet. While the dog was initially still alive, she had to be put down later because of the extent of her injuries, Popowich said.

She said the complainants pointed police toward Mark Walter Kotylak as being the alleged driver. Police initially didn't find the 43-year-old Regina man at home, but Kotylak went to police headquarters Saturday and turned himself in, Popowich said.

He's charged with two counts of assault with a weapon for allegedly using the car against the two people. Popowich said he's also facing a cruelty to animals charge for allegedly willfully causing the dog's death "by intentionally running her over with his vehicle."

Kotylak made his first appearance at Regina Provincial Court Monday, at which time he was released on a number of conditions, including that he not drink or use non-prescription drugs and not contact the alleged victims. He returns to court later this month.

The Crown is proceeding by indictment, the more serious way of treating a charge.


Case Updates

A man facing charges for allegedly trying to hit two people with a vehicle before running over a dog is being given another chance at freedom on bail.

Mark Walter Kotylak was initially charged following an incident on Nov. 5 in which police said a vehicle drove towards a Patricia Street resident and his neighbour, then ran over the resident's dog. The dog had to be put down the next day.

Kotylak, accused of being the driver of that vehicle, is charged with two counts of assault with a weapon (the vehicle) and one count of animal cruelty in relation to that incident.

He'd been released on conditions, but ended up back in custody on Nov. 11, charged with breaching release conditions, possession of cocaine, theft under $5,000 and possession of stolen property under $5,000. The first two new charges were laid following a vehicle stop, and the last two relate to warrants dating back to July.

Kotylak appeared back in Regina Provincial Court Wednesday, at which time the Crown again agreed to his release on conditions that include that he maintain a curfew of 11 p.m. to 7 a.m., not possess or use alcohol or non-prescribed drugs, not go to bars or liquor stores, and take assessment, education and/or treatment for substance abuse if directed to do so.

He returns to court Dec. 1.
