Annette Rohena, 46, was charged on Aug 1 with cruelty to animals and confinement or abandonment of animals. On April 30, Animal Control went to her home, listed on a booking form as 176 Deerfield Ave., Port Charlotte, in response to a call about a dog left in a wire cage in direct sunlight without water. The temperature that day was recorded at 92.8 degrees, Jones said.

Animal Control arrived to find Pooch, an 18-pound miniature pinscher, with a temperature of 108.4 degrees, Jones said.

"We saved that dog's life," Jones said. "We got there in the nick of time to get that guy out of there."

However, Rohena said Pooch had water and was in a large enclosure, which she would put a blanket over. She said that in the over three years she owned him, Pooch received food and water, and she would check on him in the middle of the day to make sure he had enough water.

"The whole situation has been ridiculous," she said. "My dog was a very healthy dog."

Pooch was taken to a veterinarian, where he was given fluids and various measures were taken to lower his temperature, Jones said. Pooch was also treated for infections.

Rohena signed custody of Pooch over to Animal Control the next day, and he was adopted out of the Animal Welfare League shelter in Charlotte Harbor. While he was at the shelter, Rohena said she called to check on his welfare. She said she gave up Pooch only after Animal Control told her she would lose him anyway.

"I was upset," she said, "But they told me if I took the dog back, they were going to take the dog back anyway."

Rohena posted $5,000 bond.
