A Dawson man has been held for court in Fayette County on animal cruelty charges.

Scott Allen Newcomer, 21, of 3038 Valley Drive, allegedly stabbed a 7-week-old female Sharpei and Labrador mix puppy with a fork and burned the puppy's ears after it defecated on Newcomer's pants.

The incident occurred at about 1:30 a.m. Nov. 25 at an apartment along East Apple Street.

Fayette County Assistant District Attorney Mark Brooks questioned Jeanne Russman, who said she had seen the puppy Nov. 24 before it was injured and saw the puppy after it was injured when a group of children brought it to her Nov. 27.

She said Newcomer told her that he burned and stabbed the dog.

Also questioned at District Judge Ronald Haggerty's office was Connellsville Police Officer Autumn Fike, who previously interviewed Newcomer, who told her that the dog did soil on his pants, but claimed that he just rubbed the dog's nose in the feces.

Fike said the puppy was examined by veterinarian William Sheperd, who reported to Fike that the puppy's wounds were consistent with being stabbed with a fork.

Fayette County Public Defender David Kaiser wanted to dismiss the charges against Newcomer because Russman did not see Newcomer torture the puppy.

"There's not one single eyewitness to testify that he stabbed or burned that dog," Kaiser said.

District Judge Ronald Haggerty denied Kaiser's motion.

Kaiser retracted a request to have Newcomer's bond reduced after Newcomer whispered that he didn't want to have his bond reduced.

Brooks said he would have objected to a request for bond reduction.

"I would have, too," Haggerty said.

Newcomer remains in the Fayette County Prison.

According to court records, a nolle prosequi was filed on the animal cruelty case against Scott Newcomer on June 5, 2007. A nolle prosequi is an entry made on the record by a prosecutor in a criminal case stating that he will no longer pursue the matter. This entry may be made at any time after charges are brought and before a verdict is returned or a plea entered. Essentially, it is an admission on the part of the prosecution that some aspect of its case against the defendant has fallen apart. This entry does not prevent charges from being refiled if circumstances warrant.

Scott Allen Newcomer will appear in court for a pre-trial conference on April 30, 2007 at 9:00 a.m. He is facing animal cruelty charges for allegedly stabbing a 7-week-old female Sharpei and Labrador mix puppy with a fork and burning the puppy's ears last November.
