A Billings woman drove through a fenced-in backyard, hitting a dog and a pickup, then attacked an onlooker before getting back in her car and driving off, police said.

Police were called about 4 p.m. on Oct 6 to 531� Ave. D, a small, single-family house behind the 531 address at the rear of a large lot, authorities said.

The driver, Cynthia Foley, 45, was later stopped more than a mile away, said Billings Police Officer Mike Gilluly, who assisted in the woman's arrest.

"She nearly rear-ended me," Gilluly said. Police gave the following account of the wreck:

Foley, in a green Ford Taurus, was heading eastbound through the alley on the north side of Avenue D when she cut through the parking lot of The Church of Jesus Christ of Latter-day Saints. The woman swerved though the chain-link fence behind the house, hitting the dog and then a Ford pickup.

The dog, a pit bull mix, died as a neighbor stood beside it and used a cell phone to call for help.

That same neighbor had walked out to find Foley standing outside her car, wearing a black, plastic garbage bag over her clothing.

The neighbor saw Foley attempting to get back into her car and told her not to leave.

"She said, 'You can't tell me what to do ...' " said Toni Emerson, a witness who lives at 531 Ave. D and rents out the house at the back of the lot.

"Then I saw her (Foley) come after her," Emerson said. "She was kicking at her and grabbing at her."

Foley got back into her Taurus and took off westbound on Avenue D, leaving her bumper and license plate behind, police said.

Emerson's tenants had just left the home, where they have been living for about a year, she said.

"That was their child," she said nodding to where the dog lay. "That was their baby."

Animal Control Officer Keith Padden estimated the dog was 3 years old, based on the condition of its gums. He said the animal appeared to die of head injuries.

Foley was charged with obstructing a police officer and assault, both misdemeanors, as well as traffic charges, Gilluly said. They include reckless driving and leaving the scene of an accident.

The animal control office will consider charges of animal cruelty, Gilluly said.

The woman was being held on $1,380 bond at Yellowstone County Detention Facility.
