Police said they are looking for the person who beat a small dog and left it in a portable toilet on a construction site. The dog later had to be euthanized.

Luanne Longfellow, the dog's owner, said she got a call from a housemate on the afternoon of Feb 3, 2006 that her 5-pound Chihuahua-papillon mix named Brenal could not be found. She searched the neighborhood, taking her other dog with her.

At about 6:30 p.m. she found Brenal, covered with chemicals and barely alive, in a portable toilet at a construction site about a block from her Bay Avenue home, Longfellow said. She rushed the dog to the emergency veterinary service in Linwood, but Bernal had to be put down because of the severity of his injuries.

The veterinarians said Brenal's injuries indicate he was beaten, Longfellow said.

"I can't understand that this happened,� Longfellow said. �I won't let my older dog out. I tell everyone on the block to keep their dogs inside."

Case Updates

Kelly is charged with animal cruelty and is free on bail. If convicted, he could face a fine up to $15,000 and three to five years in prison.

Kelly has a court hearing scheduled for Feb 7, 2006.

Luanne Longfellow said that the family left Brendal alone with Kelly on Friday afternoon in their Ocean City home. She said that Kelly called her later in the day and said the dog was missing and then pretended to help her search the neighborhood for him.

"He called me at 6:24 and said, 'I think I found the dog,'" Luanne Longfellow said.

Longfellow said that Kelly had her come to a portable toilet at a construction site, just a block from her home.

"The dog was submerged into the port-o-potty to where just a little bit of the side of his face, where his mouth and his eye were showing. He was still breathing, but barely," Luanne Longfellow said.

Kelly was questioned by police and allegedly confessed to the crime.

Mandie Longfellow said that Kelly would often get frustrated when Brendal relieved himself inside the house, but said that she never thought he would actually hurt her tiny pet.

Police say an 18-year-old Somers Point man beat a dog discovered in a portable toilet at an Ocean City construction site Friday.

The Ocean City Police Department said James P. Kelly IV was watching the dog when he apparently became upset with it and beat it, severely injuring the animal.

Kelly, whom police said has a relationship with Brendal's owners, was charged Sunday with animal cruelty.

Penalties for the offense can include a fine of as much as $15,000, a custodial sentence of between three and five years and community service for as many as 30 days, Ocean City police said.

Kelly was released after posting $1,000 bail.
