Marshall county farmer Al Denoon told a Marshall County Magistrate judge he wants a jury of his pears to hear his case. Inside and outside of the court room Denoon was fighting for what he says is his livelihood.
Dozens of farmers showed up to the court appearance to show their support. Many say they have the same problems with wild animals.
West Virginia conservation officer J.A. Fayak wrote the citation for shooting with in 500 feet of a house. Fayak says the citations are not meant to harm farmers but to keep the public safe.
The Marshall County prosecutors office agrees. "This raccoon, to my knowledge, there is no evidence it was killing, or just come from killing any animals, said assistant prosecutor Eric Gordon.
