Dog beaten with rolling pin
Lowell, MA (US)

Incident Date: Sunday, Jan 18, 2004
County: Middlesex

Disposition: Alleged

Alleged: David Miguel

Case Updates: 1 update(s) available

A Lowell man was arrested yesterday on charges that he struck his dog at least three times with a rolling pin on Jan. 18. David Miguel, 28, of 320 Douglas Road, turned himself in to Hudson police on March 22nd just before 11 a.m.

He was held without bail and charged with cruelty to animals, a class B felony.

After responding on Feb. 5 to an animal-cruelty complaint on David Drive, animal control officer Jana McMillan and Detective Dan Dolan concluded Miguel hit his brindle boxer, Xena, three to five times with a rolling pin.

The alleged assault left Xena with a 2-to-3-inch laceration on the head and a bloody nose, police said. Xena was treated at the Hudson Animal Hospital for her injuries.

For the time being, Xena is in police custody until McMillan can find her a new home.

If convicted, Miguel could face 3 1/2 to 7 years in prison.

Case Updates

Miguel was indicted and will now have to appear in Superior Court.

The dog named Xena is doing fine. She has not been placed (adopted) because Miguel wants her back. She remains in the custody of the Animal Control Officer until the case goes to trial.
