David was charged with misdemeanor animal cruelty for keeping six German shepherds on his boat in allegedly unsanitary conditions. based on the dogs' condition when they were removed from his boat three days after David's May 1999 arrest.
The animal cruelty charge covered only the days immediately after David's arrest for allegedly spending years beating his wife Linda David while hiding her away on a filthy sailboat.
David's attorney, Brian Hershman, said that made no sense because Snohomish County sheriff's deputies helped create the unsafe condition by leaving the dogs locked up on David's boat when they hauled him away to jail. The judge dismissed the animal cruelty charge he rejected Hershman's motions to dismiss the more serious assault charge against his client.
Prosecutors said Friday they believe the abuse was part of continuing criminal conduct that wasn't discovered until 1997. They plan to show abuse left Linda David with scars on her face, cauliflowered ears, retinal hemorrhages that contributed to blindness and a broken bone in her left forearm that healed without medical intervention.
Linda David remains at a Snohomish County nursing home. Hershman told the judge he interviewed her early this month, and she told him her husband did not harm her and that her injuries were caused by falling down on the boat.
Brain damage and other medical problems have left Linda David legally unable to care for herself. Wynne said he will conduct a Sept. 18 hearing to determine whether she is competent to testify at her husband's trial.
