The case ATEA spread at the time (August 2011), in which Txispas died as a result of the shooting and spearing by a local resident Bedia Vizcaya, comes to an end. And although we believe that punishing the aggressor is far from deserving the at least proved damning, which is assumed to continue taking steps, slow but solid in the right direction.

ATEA has had access to the court ruling, which estimated that the facts alleged against him to the person accused, who admits he had shot the animal, which topped piercing his chest with a metal bar. Txispas, mortally wounded, tried to return home, the ground-Bizkaia ASAAM (Animal Relief Association Friends of Milord) was then enabling as shelter for abandoned animals. One of the volunteers found the body after following his trail of blood. The veterinarian in charge of performing a post-mortem said at the time that Txispas suffered "excruciating agony". According to sources of the association, "Txispas was a very friendly dog, not at all aggressive, despite having always been tied" and that "thanks to the intervention of the association significantly improved quality of life, after allowing its owner to volunteers to take charge of him and another partner. "

The text of the judgment leaves no doubt: the defendant pleads author Txispas violent death, and admits that his performance with trying to kill the animal painfully. So, Judge, following Article 337 of the Penal Code, condemns him with 5 charges:

1. "Four months in prison."

2. "Disqualification for the right to be elected during the term of the sentence."
3. "Special disqualification for the exercise of profession, trade and commerce which are related to animals a year's time."
4. "Payment of the costs."
5. "To compensate S.G.R. veterinary expenses for derivatives (€ 348.33), plus interest. "

El caso que ATEA difundió en su día (agosto 2011), en el que Txispas falleció a resultas de los disparos y posterior alanceamiento por parte de un vecino de la localidad vizcaína de Bedia, toca a su fin. Y aunque consideramos que el castigo al agresor dista mucho de ser el que merece, al menos ha resultado condenatorio, lo cual supone que se siguen dando pasos, lentos pero sólidos, en la dirección adecuada.

ATEA ha tenido acceso a la sentencia judicial, que estima probados los hechos que se le imputan a la persona denunciada, quien admite haber disparado sobre el animal, al que remato atravesándole el pecho con una barra metálica. Txispas, herido de muerte, trato de volver a su hogar, el terreno que ASAAM-Bizkaia (Asociación Socorro Animal Amigos de Milord) se encontraba entonces habilitando como albergue para animales abandonados. Una de las voluntarias encontró el cadáver tras seguir su reguero de sangre. El veterinario encargado de realizarle la autopsia aseguró en su día que Txispas padeció "una agonía atroz". Según informaron fuentes de la asociación, "Txispas era un perro muy amistoso, en absoluto agresivo, a pesar de haber estado siempre atado", y que "gracias a la intervención de la asociación mejoró notablemente su calidad de vida, tras permitir su dueña que los voluntarios se encargaran en parte de él y de otro compañero".

El texto de la sentencia no deja lugar a dudas: el acusado se declara autor de la violenta muerte de Txispas, y admite que con su actuación pretendía matar al animal de forma dolorosa. Así, la jueza, en aplicación del artículo 337 del Código Penal, le impone una quíntuple condena:

1."Cuatro meses de prisión".

2."Inhabilitación especial para el derecho de sufragio pasivo durante el tiempo de la condena".
3."Inhabilitación especial para el ejercicio de profesión, oficio y comercio que tenga relación con animales por tiempo de un año".
4."Abono de las costas".
5."Que indemnice a S.G.R. por los gastos veterinarios derivados (348,33 €), más intereses".
