A Spanaway man believed to be the first person in the state charged under Washington's new bestiality law bailed out of the Pierce County Jail on Oct 20.

Pierce County prosecutors say 26-year-old Michael Patrick McPhail was caught by his wife on Oct 18 night having intercourse on the back porch with their four-year-old female pit bull terrier.

The wife took photos with a cell phone and called police.

Pierce County sheriff's spokesman Ed Troyer says "There's pretty clear proof what happened to this dog."

McPhail was arrested that night.

Charged with animal cruelty, he could be sentenced to a year in jail if convicted.

The bestiality law took effect in June. It was prompted by an incident in Enumclaw where a man died after having sex with a horse.

A man accused of having sex with a dog was found not guilty Wednesday. A Pierce County jury acquitted Michael Patrick McPhail, 26, who had been tried on the charge of first-degree animal cruelty. McPhail said he believes his wife, Jesika, made up the story because she is seeking to end their marriage.

Jury selection began this week in Tacoma for the trial of the first person charged in Washington under a new law that made bestiality a felony.

Twenty-six-year-old Michael Patrick McPhail is accused of having sex last October with his family's dog, a pit bull named Sarah.

He has pleaded innocent to animal cruelty. If convicted he could be sentence to a year in jail.

The bestiality law took effect in June. It was passed by the Washington Legislature because of the death of a man who had sex with a horse.

The trial will resume on April 30 for a man charged under Washington's new felony bestiality law. The trial for Michael Patrick McPhail began on April 16 in Pierce County Superior Court, but was interrupted.

Pierce County prosecutors say that on October 18, 2006, 26-year-old Michael Patrick McPhail was caught by his wife having intercourse on the back porch with their four-year-old female pit bull terrier.

The trial is set to resume on April 30, 2007, at 9:30 .am.

A man charged under Washington's new felony bestiality law will go on trial April 16, 2007 at 9:00 a.m. in Pierce County Superior Court.

A man accused of having sex with the family dog has been charged under the state's new animal cruelty law, which makes bestiality a felony, a prosecutor said.

Michael Patrick McPhail, 26, of nearby Spanaway pleaded not guilty Thursday to one count of first-degree animal cruelty in Pierce County Superior Court.

Assistant Pierce County Prosecutor Karen Watson said McPhail was the first person in Pierce County to be charged with the new bestiality offense.

McPhail posted $20,000 bail Friday. Judge Katherine Stolz has set a trial date of Dec. 11.

McPhail's wife told investigators that she found her husband on their back porch Wednesday night having intercourse with their female pit bull terrier.

The dog was squealing and crying, according to charging papers.

The woman took photos with her cell phone and called the sheriff's office.

Calls to McPhail's public defender, David Katayama, were not immediately returned Friday.

The bestiality law, which took effect in June, was prompted by a case near Enumclaw in which a Seattle man died after having sex with a horse. Before the law was enacted, Washington was one of 14 states where bestiality had not been explicitly prohibited.
