After winning a new trial by appealing his convictions in a cockfighting case, a Wailuku man has agreed to plead in the case and was placed on five years� probation on Oct 5, 2006 as part of the plea agreement.

No further incarceration was ordered for 63-year-old William Dutro III, who had been imprisoned for one year and six months before his convictions were set aside and he was released earlier this year.

"I�m glad to be home with my family, and you won�t see me again," Dutro said in court.

Dutro was among more than 20 people indicted on felony charges as part of a police investigation into two illegal cockfighting organizations on Maui in 2002.

During a trial in July 2004, undercover police officer Bryan Manlapao described seeing Dutro near the cockfighting ring a half-dozen times at cockfights organized by a group headed by Daniel Javier. The officer reported seeing Dutro weighing fighting chickens for about 25 minutes at one cockfight.

A 2nd Circuit Court jury found Dutro guilty of racketeering, first-degree promotion of gambling and cruelty to animals.

In December 2004, he was sentenced to a 10-year prison term. As a repeat offender, he was ordered to serve at least three years and four months of the term before being eligible for parole.

After his requests for a new trial were denied, Dutro appealed. In May, the state Intermediate Court of Appeals sent the case back to 2nd Circuit Court for a new trial.

As part of a plea agreement involving the defense, prosecution and 2nd Circuit Judge Shackley Raffetto, Dutro subsequently pleaded guilty as charged to racketeering, first-degree promotion of gambling and cruelty to animals. He was released from prison in July.

Raffetto ordered Dutro not to participate in gambling activities, including cockfighting, as a condition of his probation.
