Troy Brienzo, 12, now says he wonders if his cat is still alive.

On Monday, Aug 28, Brienzo came home from school to the Victorian Village apartment complex and found the door was unlocked and his 9-week-old kitten missing.

"Where's Ms. Kitty? Did I let her out? Did somebody take her?" Troy said.

Troy, who says his mother, Denise, was in the hospital at the time, asked his grandmother to call the Parker Police Department.

According to police, Brienzo's 54-year-old landlord, Warren Smalley, took the cat from the apartment.

A spokesperson for the town of Parker says Smalley told police he initially went into the apartment to perform some maintenance.

Smalley spotted Ms. Kitty and took the cat to a site in Arapahoe County where he let it go, according to police.

Smalley says the cat violated the complex's zero tolerance policy on pets.

"So he believed it was within his rights to take the animal from the apartment, but of course it is not the best way to handle the situation," said Sara Walla, spokesperson for the town of Parker.

Smalley was arrested and cited for cruelty to animals and theft. Denise Brienzo said she has had a turbulent relationship with her landlord but she says it was nothing to justify what happened.

"A person who could do that and throw the cat out has no conscience," she said.

Smalley is due in court in October.

Meanwhile, the Brienzos are being evicted because of rent problems and have to find a place to live.

While they search for a new home, they're also searching for some hope that their kitten is still alive and will be found.
