A state appeals court on August 31, 2006 reduced a damage award for a Montello man who sued his neighbor for poisoning Lucky in 2003.
Christopher Klahn filed suit in small claims court in Marquette County in 2005 alleging his neighbor Patricia Vajgrt fed the dog food tainted with antifreeze at least twice. A test showed the dog had died from consuming antifreeze.
At a trial, five witnesses testified they saw Lucky eat from plates of food left in Vajgrt's garden and that she often expressed displeasure about the dog coming onto her property unleashed. Vajgrt denied any wrongdoing, but the court ruled in Klahn's favor and awarded him damages of two and a-half thousand dollars.
The appeals court upheld the verdict, but reduced damages to about eleven-hundred dollars.
