On Sunday, July 30, 2006 at 12:20 pm, Trooper First Class (TFC) Rossignol of the Maryland State Police, responded to the parking lot of Belk Department Store, California, for a report of a dog locked in a vehicle. The temperature outside was 98 degrees.

TFC Rossignol had the store make an announcement over the intercom for the owner to return to their vehicle. Approximately 5 minutes later, Cathy Dwyer Kleinbeck, 58, of Dowell, responded to the vehicle.

On Monday, July 31, 2006, Ms. Kleinbeck was served with a criminal summons charging her with animal cruelty, endangering the health, safety and welfare of a dog by leaving it unattended in a motor vehicle, and parking in a handicapped space.
