The Atlantic County Society for the Prevention of Cruelty to Animals on Feb 28 filed charges against a local man accused of neglecting to properly care for his four horses, leading to one horse's death.

According to county SPCA President Nancy Beall, society agents charged James Giblin with four counts of animal cruelty. Each count carries a maximum fine of $1,000 and the possibility of as many as 6 months incarceration.

Giblin will be arraigned on the charges and will face a hearing in Municipal Court in the coming weeks, Beall said.

Beall said the three horses removed from his property on Mays Landing-Somers Point Road will remain in the care of the SPCA. She said all three are recovering quickly - one has gained 75 pounds in less than two weeks, she said. The society plans to petition the court for their permanent custody should Giblin be found guilty.

According to Beall, a concerned neighbor called a veterinarian to Giblin's property during the night of Feb. 12. The veterinarian - who apparently was given permission by Giblin to assess the horses - determined that each was significantly malnourished.

One of the horses was "completely emaciated," lying out in the field in the bitter cold and unable to get up, and the veterinarian decided to euthanize it on the spot, Beall said. The veterinarian called the SPCA about the other three horses, one of which Beall said also was emaciated.

SPCA agents arrived the next morning and, based on what they found, applied for a search warrant and removed the three remaining horses from the property, Beall said.

Beall said Giblin, when asked about the horses' conditions, "offered no kind of explanation" and told agents that he typically bought a bale of hay for them every other day. Beall said such an amount is grossly insufficient to feed four horses. She also said their drinking water was "one big chunk of ice."
