Dog fatally beaten for chewing on kitchen floor

Leo Rogers, a 44-year-old ex-convict, was arrested on an animal-cruelty charge after he allegedly beat his puppy to death with a broom handle at his Titus Avenue home, police said.
 
The man allegedly killed the dog, a 11/2-month old chow-shepherd mix, because it was chewing on the kitchen floor.

Rogers' girlfriend told police that Rogers beat the puppy, named Major, with a broom handle and threw it around the kitchen. The puppy began to bleed out of its ear and then died, she said. The girlfriend carried the dog outside and left it near bushes off Broadway.

Police Officer Richard Cruz arrested Rogers and charged him with one count of cruelty to animals. Rogers was released from Wyoming Correctional Facility, Attica, in 2004 after serving six years for aggravated criminal contempt.


Case Updates

Leo Rogers Jr. was ordered Tuesday to serve a one-year jail term for beating his 6-week-old puppy to death last summer.

In imposing the sentence on Rogers, 44, of Titus Street, Senior Erie County Judge Michael L. D'Amico he told him to "try to get your life together."

Under the state's good-time sentencing laws, Rogers will remain in custody only about another month because his has been jailed since June 9, the day the puppy was killed.

The judge also fined Rogers $160 and issued a five-year order of protection barring him from trying to contact the prosecution witness.

Prosecutor Jaime L. Cirulli said Rogers was arrested after the witness, whom she refused to identify, called police to report that Rogers had beaten his chow-shepherd puppy because the dog wouldn't stop chewing on the flooring in his kitchen.

Cirulli said Rogers had a friend dump the dead puppy in bushes near his home.

Rogers pleaded guilty Nov. 14 to a felony charge of aggravated cruelty to animals.
