CONVICTED: Was justice served?

Please vote on whether or not you feel the sentence in this case was appropriate for the crime. (Be sure to read the entire case and sentencing before voting.)

weak sentence = one star
strong sentence = 5 stars

more information on voting

When you vote, you are voting on whether or not the punishment fit the crime, NOT on the severity of the case itself. If you feel the sentence was very weak, you would vote 1 star. If you feel the sentence was very strong, you would vote 5 stars.

Please vote honestly and realistically. These ratings will be used a a tool for many future programs, including a "People’s Choice" of best and worst sentencing, DA and judge "report cards", and more. Try to resist the temptation to vote 1 star on every case, even if you feel that 100 years in prison isn’t enough.

Case #8105 Rating: 3.5 out of 5

Hoarding - 10 cats seized, 5 found dead
Woodcliff Lake, NJ (US)

Incident Date: Wednesday, Jun 30, 1999
County: Bergen

Disposition: Convicted

Defendants/Suspects:
» Gerald M. Barrack
» Herta Barrack

Dr Gerald M. and Herta Barrack agreed to a plea bargain in municipal court to charges of animal cruelty and were fined $6,000 each for animal mistreatment of more than a dozen cats at their home.

In July, they were issued summonses charging each of them with 45 criminal and civil counts of violations that stem from authorities finding dead cats, diseased kittens, and starving stray felines at their ramshackle home on Pinecrest Drive. In total 15 cats were found. This includes five dead kittens and four that were later put to sleep because they were so ill.

Mr & Mrs Barrack were away on separate trips when officials from the Bergen County Society for the Prevention of Cruelty to Animals went to their home responding to complaints from neighbors.

Gerald Barrack, a specialist at Prosthodontic Associates of Ho-Ho-Kus, pleaded guilty to six counts of cruelty charges.

Herta Barrack pleaded guilty to five animal cruelty charges and a disorderly persons charge.

Municipal Judge Patrick Randazzo, said "No animals should exist under such circumstances ... This type of condition shouldn't repeat itself."

Borough officials found the interior of the dilapidated ranch home soiled with cat feces and urine. The home is assessed at $279,600 and is uninhabitable because of the stench and a fire hazard because of its unkempt condition.

The Barracks plan to repair the home so they can sell it.

Note: Classifications and other fields should not be used to determine what specific charges the suspect is facing or was convicted of - they are for research and statistical purposes only. The case report and subsequent updates outline the specific charges. Charges referenced in the original case report may be modified throughout the course of the investigation or trial, so case updates, when available, should always be considered the most accurate reflection of charges.
