(2/21/2001) Charged by the USDA for violations of the Animal Welfare Act. Violations were in the areas of recordkeeping, housing, sanitization, veterinary care, and dog exercise.

(10/14/04) The caulk used to seal the edges of the shelter have broken down or not maintained their attachement to the surfaces of the floors and walls. This allows for the material to separate and provides a crevice that cannot be properly cleaned and sanitized. The owner must repair/replace this caulk with some material that will not separate and will provide a surface that can be cleaned and sanitized in the appropriate manner This affects the dogs in pens numbered 24-42 (count is70 in all). Not all enclosures have this condition but the owner needs to check each shelter and make sure that this does not happen.

(10/14/04) The washdown of the small dog hutch in the center of the facility shows evidence of being repaired in the past. At this time there are new cracks in the material that suggests that the material is breaking down and cannot be repaired successfully. The owner must replace this plastic washdown . This washdown has been cited on the inspections of 25 Aug 2003 and 12 Feb 2004 and each time a follow up inspection was completed it was satisfactory. This washdown has reached the point where it is no longer feasible to repair. This affects 12 dogs.

(2/12/04) There were 2 poodles in cage # 31 that had severe matting all over their body. There were mats on the ears of both dogs and hair loss on the male dogs ears. There was a Maltese in pen 32 that had matted hair. There was fecal material in the mats under the tail. These dogs did not seem to be in any pain. These animals must be groomed and thoroughly checked for any irritations resulting from said matting. Grooming must be continued on an ongoing basis at all times. This affects 3 animals

(2/12/04) There were two enclosures in the puppy building that were not structurally sound. One enclosure, with a Shar-pei puppy, approx. 4 months old, was not adequately anchored to the support frame. The entire cage would shake when the puppy moved around. The other enclosure contained three large puppies. The floor of this cage was sagging significantly under the weight of the animals. The licensee stated that this was a temporary situation and would be rectified as soon as they cleaned an enclosure, allowed it to dry, and moved the puppies. All of these puppies must be placed in pens that are structurally sound. This affects four animals.

(2/12/04) The food storage area was cluttered and dirty. There was spilled food and rodent feces on the floor. The food bags were stored on pallets but they were not sufficiently away from the walls to allow for proper cleaning. Empty feed sacks were piled in the corner and the whole building was cluttered with kennel and non kennel materials and equipment. This affects all animals in the facility

(2/12/04) There were several feed sacks full of trash at the facility. These were located outside several of the buildings and in the food storage area. All trash must be placed in a closed container with tight fitting lid. This affects all animals in the facility

(2/12/04) There was an area (North central) where the Bostons and other small dogs were kept that has waste on the ground from a leak in the drain. This drain must be repaired and the waste cleaned up to prevent the spread of inspects/ pests/ and diseases. There was also a buildup of fecal waste and hair on the ground at the eastern end of the old whelping building that had been washed from the washdowns. There was more than one days accumulation of fecal material in the top washdown. These areas must be cleaned and or repaired. This affects all animals in the facility

(2/12/04) There was no bedding provided for most of the animals. The current temperature at time of inspection was 26 deg by Kestrel. The overnight temperature was below 35 deg F. The owner must provide proper bedding for the animals when the temperatures are below 50and additional bedding when the temperature is below 35 degrees. Some of the other enclosures had cloth furniture covers, some had heating pads, some had low wattage light bulbs. The floor temperature in 2 of the hutch enclosures was 26deg F. The ambient temperature of 2 hutch enclosures with light was 39 deg F. The licensee must provide clean dry bedding or other appropriate heat source in all shelters of the outdoor enclosures. This affects 85 dogs. To be corrected immediately. The owner has started putting cedar chips in some of the igloo shelters.

(2/12/04) The building on the NW Side directly above the mastiffs had unsealed wafer board between the outside runs. There were areas on these boards that had been chewed on by the dogs. All surfaces that come into contact with the animals must be impervious to moisture. These boards must be sealed/ covered/ or replaced. This affects 13 dogs

(2/12/04) There were several entryways to shelters or outside runs that had the vinyl/fiberglass covering torn off and/or the edges were ragged. There were in the 3 Hutches in the SE Portion of the kennel and in the old whelping building. All surfaces that come in contact with the animals must be impervious to moisture and must not have any edges that might injure the animals. These surfaces must be repaired or replaced. This affects app 70 dogs.

(2/12/04) There were several self feeders in this facility that were dirty. This is a buildup of dirt and grime on the doorway of some feeders and on the outside surfaces of the other feeders. Some of the feeders had a buildup of oils from the animals that caused an accumulation of dirt on the rubbed side surfaces of the feeders. One of the enclosures had a feeder that had rodent feces on the top surface. All food receptacles must be kept clean and sanitized at a minimum of every 2 weeks. These feeders need to be cleaned and sanitized before they are used again. This affects 18 dogs.

(2/12/04) The owner must clean the areas of the hutches next to the rear walls of the wire pens. There is a buildup of debris and fecal matter that has accumulated over a period of time. There is an accumulation of hair hanging on the underside of the wire of these cages (SE Hutches - 3 buildings). There is also an accumulation of dirt/grime/ food/ fecal material in the bottom of the entrance to the shelter. The areas of the entrances to the shelters is not properly sealed or finished to prevent the build up of this debris in these areas. These areas must be cleaned daily. This affects app 50 animals

(2/12/04) There was more than one days accumulation of feces in 3 of the outdoor enclosures. The waste/fecal matter in pen 71 covered more than 75% of the surface area. The 2 dogs present did not have clean dry areas to sit or lie down. In pen 68- the ground had more than 1 days buildup of waste/fecal matter and a strong urine odor present. The pen containing the 2 Neapolitan mastiffs had a build up of fecal matter/waste and water/urine in the SE corner. This affects 6 dogs

(2/12/04) There are cracks in the washdown of the small dog hutch in the north central section of the facility. This allows waste and debris to accumulate and does not allow for proper cleaning and sanitation of this hutch. This presents a good breeding area for disease and odors. This was listed as a non compliance on the inspection of Aug 25, 2003. This affects approximately 8 animals.

(2/12/04) There is not an effective pest control program in effect at this time. There was rodent fecal waste on the north side of the SW building of the kennel facility. There was also rodent fecal waste on the top surface of a self feeder in this same section of the kennel. There was rodent fecal waste in the food storage building along the south wall. There was dog food that had been spilled on the floor and left there. There were rodent feces on the washing machine and on the floor of the puppy building. The owner must have an effective pest control program in place at all times. This affects all dogs in the facility.


Case Updates

In January 2006, Bond was fined $10,000 by the U.S. Department of Agriculture for violations of the Animal Welfare Act, and ordered to suspend her AWA license for a year. In April 2008, she appealed the decision to the Eighth Circuit United States Court of Appeals, but the appeal was denied late that month.
