Police have charged a couple with breaking into the Athens-Clarke County Animal Control shelter to steal their own dogs.

Both dogs are back in custody. Police arrested 22-year-old Marlanda Andrea Phillips and 23-year-old Donald Mark Gerardy, both of Athens.

Police began investigating the break-in about 8 a.m. March 13 when animal control officer Bill Wise showed police officers an empty kennel inside an unlocked fence gate. A corner of the kennel door had been pulled out, and two mixed-breed rat terriers that had been inside on March 12 were gone.

Wise told officers that Gerardy had called the shelter several times that day about coming to get the dogs. But he says the man did not show up before the shelter closed.

Police went to the couple's home. Both Phillips and Gerardy are charged with interference with government property, criminal trespass and theft of services. Phillips also is charged with possession of methamphetamine, and Gerardy is charged with financial transaction card theft.

Both are free on bond.
