A woman is facing drunk driving and child endangerment charges after police said both she and her pet Chihuahua arrived intoxicated at the woman's son's elementary school on Monday.

The Daily Herald reported that Diane Marcotte, 49, could also be charged with animal cruelty for allowing her dog to ingest alcohol prior to her arrest. The dog spent a night at an emergency veterinary clinic to detoxify, and is reported to be in good condition in the custody of McHenry County Animal Control.

Island Lake police arrested Marcotte at approximately 3:40 p.m. on Monday after she drove her vehicle across a sidewalk in front of Cotton Creek Elementary School. Marcotte told police that she had been driving erratically because the dog was having a seizure.

Jerry Rivard, the agency's manager, said when workers first saw the dog, it was completely impaired and displayed erratic behavior. Rivard said the Chihuaha would remain in the care of animal control pending a decision from the McHenry County State's Attorney on possible animal cruelty charges.

Marcotte, who lives in the 800 block of Plymouth Lane, could not be reached for comment on Wednesday, the Herald reported. Marcotte is free on bond, and is scheduled to appear in court on the charges on April 17.

Marcotte was charged with driving under the influence and two counts of endangering the life or health of a child, the Herald reported. Both charges are misdemeanors with maximum sentences of up to a year in jail and a $2,500 fine.

Case Updates

The Island Lake woman accused of driving drunk Monday with her 3-year-old daughter and an allegedly drunken pet Chihuahua in the car was charged again with drunken driving in Hoffman Estates.

Diane Marcotte, 49, of 803 Plymouth Lane, was charged with driving under the influence by Hoffman Estates police at 4:20 a.m. Thursday.

The charges came less than three days after Island Lake police charged Marcotte with driving under the influence and two counts of endangering children. Police said Marcotte arrived drunk Monday at Cotton Creek School, 545 Newport Court, Island Lake, to pick up her 10-year-old son.

Prosecutors still are considering whether to file animal cruelty charges against Marcotte. Her two children are staying with their father, who filed for divorce from her on Monday.

The 4-month-old Chihuahua, named Chico, remained in county custody Friday, said Jerry Rivard, supervisor of the McHenry County Animal Control.

Police said the dog smelled like alcohol, got sick, and was acting erratically. Blood samples were taken from the dog, but prosecutors said Friday that they cannot find a lab to test the blood for alcohol.

Marcotte was released from the Island Lake Police Department Monday after posting $100 bond.

Hoffman Estates police pulled her over for improper lane use at Route 58 and Fairmont Road, Hoffman Estates Sgt. Jim Campbell said. Marcotte posted bond and was released, Campbell said.

Generally, drivers charged with DUI face a minimum three-month driving suspension, which usually does not start until 45 days after the arrest.

Marcotte is expected in McHenry County court April 17. She is expected in Cook County court in Rolling Meadows on the Hoffman Estates charge on May 1.
