Sea gull shot, smashed with a brick

Two teens were charged after they allegedly killed a sea gull with a pellet gun and smashed it with a brick, police said. The boys, a 16-year-old from River Avenue and a 17-year-old from Dover Township, were charged with discharging a firearm within the borough and unlawful possession of a firearm, Lt. Kevin Arnold said. The boys used a pellet-firing rifle with a scope to down a sea gull near the Central Avenue pavilion, Arnold said. The incident happened around 4:30 p.m. on February 13, 2006. The boys then took the bird to the River Avenue back yard, shot it again, hit it with a brick, then buried it in the snow, Arnold said. "They said it was dead when they shot it a second time," Arnold said. "Then they did hit it with a brick, I guess to confirm (it was dead)."

The case is being sent to the American Society for the Prevention of Cruelty to Animals, which may levy cruelty to animals charges, Arnold said. The New Jersey Department of Environmental Protection's Division of Fish and Wildlife may also issue charges of hunting a nonmigratory bird. This will restrict them from receiving hunting licenses. The rifle was recovered and sent to the Ocean County Prosecutor's Office, Arnold said. "The kids seemed very remorseful," Arnold said. Their parents both stated they never had any other problems with the law. "It was just something stupid they got caught doing," he said.
