The trial against a man who shot a neighbor's dog has finished with the accused having to pay a fine of 793 euros. The accused has already threatened to kill the neighbour's dogs and in a moment of rage (as he admitted suring the trial) shot one of the dogs. He offered then to replace the dog by buying the most expensive dog in the market, but the guardians of the little animal dennounced the neighbour. The sentence is important and pioneer in spain because it includes the term "moral harm" to the guardians, acknowledging the human-animal bond and not only considering the dog as a property.

El Juzgado de Instrucci�n n�mero 1 de Vitoria ha condenado a un hombre que mat� al perro de un vecino de un tiro de escopeta al pago de 270 euros de multa y 493 euros de indemnizaci�n. La sentencia, que ha sido recurrida, reconoce el �valor de afecto familiar� del animal, lo que las asociaciones protectoras de animales consideran un posicionamiento �pionero� en el �mbito de la violencia hacia los animales, seg�n informa la agencia Vasco Press.

Los hechos tuvieron lugar el 2 de febrero de 2005, cuando el acusado cogi� una escopeta de su propiedad y le peg� un tiro al perro ratonero del vecino. El animal qued� malherido, por lo que tuvo que ser trasladado al veterinario, donde fue sacrificado.

Justo un d�a antes, el acusado hab�a comentado a la propietaria del can que estaba harto que los perros le orinaran y que se iba �a cargar a todos�, recoge el fallo. El individuo reconoci� que hab�a sido �l quien hab�a matado al perro en un momento �de calent�n� y se ofreci� a comprar a los propietarios el animal m�s caro del mercado.

No obstante, los due�os le denunciaron. La Asociaci�n para un Trato �tico con los Animales (ATEA) y la Sociedad Protectora de Animales y Plantas de �lava se personaron en el juicio como acusaci�n popular y solicitaron que le fuera aplicado al agresor el art�culo del C�digo Penal que recoge el castigo que han de recibir �los que maltraten cruelmente a los animales dom�sticos en espect�culos no autorizados legalmente�.

�Da�o moral�

El individuo ha sido condenado por un delito de faltas a pagar 100 euros por el valor del animal, 93 euros por los gastos del veterinario y otros 300 euros por el �da�o moral� causado no s�lo al agraviado, sino tambi�n �a sus familiares, incluyendo pues el valor de afecto familiar que se acredita con la actividad desplegada para salvar su vida�.

Desde ATEA valoraN la sentencia como �un peque�o pero firme paso� en la lucha por el reconocimiento de los derechos de los animales y han destacado el hecho de �asumir que un animal es algo m�s que una simple propiedad�.
