Judi Sisson, who previously had 70 animals removed from her property, has 34 more animals removed. Eric Dean Perkins, Sisson's lawyer, told Judge John A. Rank III that the search warrant presented to his client on Jan. 5, 2006 was improper and illegal. "There is no probable cause for the search on the affidavit," Perkins said.

It was the second time in three months Sisson has had animals removed from her care by Animal Care Services. In October 2005, 70 dogs and two birds were seized from her home and the Coastal Bend Small Breed Rescue shelter. She lost custody of those animals. Sisson said she was pleased Rank had dismissed hearing but she was angry that she could not have her pets back or see them. During the hearing Perkins said the search violated the Fourth Amendment of the Constitution. The Fourth Amendment guards against unreasonable search and seizure. "The inspection warrant was issued under the city code and they went in pursuant to that warrant and impounded the animals," Rank said. "The notice of the hearing said held under the health and safety code. Since the animals weren't seized under that provision, I felt it was not proper to have the hearing."
