Oreo the dog was shot and killed in November, apparently for wandering onto a neighbor's property.  Leroy Drake, 74, said that he shot the dog because it was chasing away deer that Drake was trying to hunt.

Drake owns 76 acres of woods and property in Wellington. He said that people should keep their dogs on their own property.

It's not the first time that Drake shot a neighborhood pet. He shot a golden retriever for the same reason a year ago, but the judge in the case dropped the charges, saying Drake didn't have any malicious intent.

Drake admitted that Oreo wasn't threatening him or any other humans; he was just scaring the deer.  Drake said that if a dog wandered onto his property again, he would use more discretion.
