A 21-year-old Queens man was arrested on charges of animal cruelty after he left a mother dog and her puppies in the cold and snow on his car lot without shelter. All the puppies froze to death.

The female Rottweiler had given birth to several puppies in the lot at 187-39 Jamaica Ave. There was no shelter or any way for the dogs to stay warm, said ASPCA Special Agent Joseph Pentangelo. By the time ASPCA officers received an anonymous complaint on Dec. 12, 2005, several of the dead puppies had been tossed into the trash.

ASPCA officers found the mother dog desperately trying to keep her frozen puppies warm. "They were cold to the touch," Pentangelo said. He pointed out the temperature on that day ranged from 24 to 37 degrees, but had been below freezing for several days. There was snow on the ground. Despite the efforts of staff at the ASPCA hospital, which tried to save the remaining puppies using oxygen, IV fluids, external heat and medicine to stimulate heart function, they died.

David Frank, who owns the lot, was arrested this week by ASPCA Special Agent Joanne Sandano and charged with two counts of animal cruelty. The puppies died of hypothermia. Their body temperatures were so low they didn't register on the thermometer, Pentangelo said. The mother dog, who was anemic and thin, is recovering at the ASPCA hospital.

An adult male pit bull, the father of the pups, also was removed from the site by ASPCA officers. He is being treated for intestinal parasites at the ASPCA hospital.
