A plea hearing is scheduled December 15, 2005 for Jeremy Clarke, 19, in Winnebago County Circuit Court on one count of instigating a fight between animals.

The criminal complaint states that Clarke and 28-year-old Jeffrey Langley of Neenah organized a fight between two pit bulls at Langley's Neenah apartment in July 2005. Langley will appear in court for a preliminary hearing on the same charge next month.

Neenah police began investigating the incident after receiving a tip that the fight occurred, and some local children may have witnessed it, according to criminal complaints. The children told police that they went to Langley's house to look at some puppies before Clarke brought over his pit bull. They were seated in the kitchen of the apartment before the fight. One dog was leashed. One wasn't. One of the dogs was scratched and left bloody by the fight, the complaint states. Six adults were watching. The children said the dogs fought for about 15 minutes.

When approached by police, Clarke denied that the dogfight was arranged or that any betting took place. One of the children told police that someone at the apartment asked to have the dogs broken up, but was ignored, complaints state.

Clarke faces a maximum prison sentence of three years and six months if convicted of the felony.
Langley faces an additional four years if convicted as a repeat felony offender.

Case Updates

A man accused of dog fighting had his trial rescheduled Tuesday despite a judge's recent insistence that the case go forward.

Jeremy J. Clarke's trial was postponed to make time for a jury trial that also was on the court's schedule.

"That case took precedence," Winnebago County Assistant Dist. Atty. M. Cathleen Huber said.

Clarke now will be tried on Nov. 14.

According to the criminal complaint, two children told police that six adults were present while Clarke and Jeffrey T. Langley fought their pit bulls in a Neenah home in July 2005. One of the dogs was scratched and bloody from the fight, the complaint states. The children said the dogs fought for about 15 minutes.

Clarke, 19, sought to have his trial postponed last week. Judge Bruce Schmidt denied defense attorney Erica Bauer's request based on how long the case had been pending.

In effort to avoid delay, Schmidt denied Bauer use of an expert witness during the trial. The witness wasn't reported to the court before a deadline. Prosecutors also were denied the ability to introduce certain witnesses based on how late they were disclosed.

As result of Tuesday's postponement, both the prosecution and the defense will have the opportunity to call witnesses that were prohibited as of last week.

Langley will be tried on Aug. 8.
