On September 8, 2004, several hunting dogs were discovered confined in an enclosure without food, water or care. Three of the dogs died from starvation, the others were eating off the carcasses in order to survive. James H. Smith III was arrested and charged with animal cruelty.

Smith was convicted on December 14, 2005, by a Chesterfield County court.

On November 24, 2004, Smith was sentenced to 12 months in jail; 9 months suspended for 3 years, $1000.00 fine, 50 hours of community service, indeterminate supervised probation and banned from owning or possession companion animals.
