In July 1998, the U.S. Department of Agriculture charged licensed animal exhibitor Curtis G. Foley, doing business as Welding Service in Whiteland, Ind., with violations of the Animal Welfare Act.

"We have charged Foley with several counts of failure to provide veterinary care to animals in need of care," said W. Ron DeHaven.

Other charges against Foley include:

-- Failure to provide food of sufficient quantity and nutritional value to maintain animals in good health; and

-- Failure to employ a suitable method to rapidly eliminate excess water from outdoor housing facilities for animals.

On September 20, 2000, the U.S. Department of Agriculture and Curtis and Ertis Foley, animal exhibitors doing business as Welding Service Corp., C and C Computers, and Mid-States Exotics in Whiteland, Ind., were found guilty of violating the Animal Welfare Act.

The Foleys committed several violations of the AWA including some in the areas of veterinary care, feeding, sanitation, and housing. As a result of these violations, the USDA revoked the Foleys' license and is requiring them to pay a fine of $6,667 to the Treasurer of the United States
