On February 19, 2003, Daniel Esh was issued a citation for sanitation violation by the Bureau of Dog Law Enforcement. The Bureau brought charges as a misdemeanor due to previous misdemeanor dog law violations in the past twelve months.

The case was heard in Municipal Court on April 7, 2003. Present were the Judge, two dog wardens from the Bureau of Dog Law Enforcement, Daniel Esh, his attorney, a friend of Esh's, and LCA's regional investigators.

Unfortunately, the Bureau of Dog Law Enforcement presented a very weak case, and the charges were dismissed. The dog warden not only had Polaroid pictures of such poor quality (we feel it was due to lack of proper lighting in the barn), but also failed to properly define the charges under Section 21.29, which covers sanitation. It was not clear if the citation addressed violations of (a) excreta, (b) sanitizing of the enclosures or (c) cleanliness and repair to protect the animals from injury, including insects and mammalian pests (rodents). In addition, the inspector checked "satisfactory" on all items except one, and the Judge rightfully took exception to this.
