Two Oklahoma men were charged Wednesday with leaving 38 puppies unattended in their van while they stayed overnight at a beachside hotel, police said.

Two of the 38 puppies taken from a van parked at a Daytona Beach hotel Wednesday await evaluation at the Halifax Humane Society. 

David Benjamin McCord, 27, of Ketcham, and Jeffrey Wayne Hoover, 29, of Skiatook, were charged with confinement of animals with insufficient food, water and exercise, a first-degree misdemeanor, police spokeswoman Sonja Wiles said. The men received a notice to appear with a mandatory court date.

McCord and Hoover left the puppies in a van with only a slightly lowered window. Police found the dogs when they responded to calls reporting dogs in a van in the parking lot of the Super 8 Motel, Wiles said. The puppies were found without water and food, Wiles said. The van, water and food bowls, as well as the van's floor, were covered with feces and smelled of urine, she said.

McCord and Hoover told police they drove from Oklahoma with 50 puppies. They had 38 left because they made stops in Georgia where they sold some of the dogs. They said they were preparing to go to Orlando to sell the remaining 38 puppies, Wiles said.

The Daytona Beach animal control officer who found the puppies placed them in the care of Halifax Humane Society, where they are being treated, said Dr. Jill Bates, the society's veterinarian. One puppy was ill but was improving with treatment, Bates said.

"They were brought in in a very sad condition," Bates said. "Several were dehydrated, had diarrhea and were covered with feces." The puppies were of a variety of breeds, including mastiffs, basset hounds, beagles, Scottish terriers, cocker spaniels and others.

Case Updates

An all-female jury announced the men not guilty Wednesday April 16, 2003. The surviving puppies were adopted after a judge awarded custody to the Humane Society, but Hoover and McCord's attorney said they plan to try to get the dogs back.
