A Town of Hartford man clubbed his girlfriend's 11-year-old dog with a sledgehammer, killing it, and then several days later beat the woman, breaking her cheekbone and biting her, according to a criminal complaint.

On Nov. 14, the complaint says, the woman saw Frank A. Westphal, 44, carrying a bloody sledgehammer, come from behind a trailer where the dog had been resting on property they share in the Town of Hartford. When the woman asked Westphal what he had done, Westphal replied that the dog "didn't feel a thing," the complaint says.

On Nov. 19, a Washington County sheriff's deputy went to the property and found a dead Rottweiler.
The complaint also says that on Nov. 18, Westphal pummeled the woman with a fist on her head and face. She escaped from the house the next day at about 6:30 a.m. with her 8-year-old son and walked to the emergency room at Aurora Medical Center in Hartford, the complaint says. There, it was found that she had a broken cheekbone, a broken hand, a bite mark to her shoulder, abrasions to her neck, a black eye and bruises on her face, head and shoulders, according to the complaint.

Westphal has been charged with mistreating an animal and causing its death and aggravated battery, both felonies, and with misdemeanor battery. If convicted on all charges, he could be imprisoned for 10 years. The woman has sought a temporary restraining order against Westphal.
He paid a $367 fine after pleading guilty in July 2004 in Waukesha County to a charge of disorderly conduct stemming from a domestic situation.

Westphal remained in custody at the Washington County Jail on Tuesday in lieu of $10,000 bail.
