In May 1996, the U.S. Department of Agriculture agreed with licensed animal exhibitor Francis R. Mercier, president and owner of Santa's Pet Farm, Inc., in Munising, Mich., to a civil penalty of $1,000.

APHIS charged Mercier with failing to:

-- construct and maintain facilities for animals so that they are structurally sound, in good repair, and appropriate for the animals involved, including a suitable perimeter fence at least eight feet in height;

-- keep food and water receptacles clean and sanitized;

-- keep the premises clean and in good repair and free of accumulation of trash;

-- failing to establish and maintain programs of disease control and prevention, euthanasia and adequate veterinary care under the supervision and assistance of a doctor of veterinary medicine; and,

-- maintain records of the acquisition, disposition, description, and identifications of animals as required
