In July 1999, the U.S. Department of Agriculture charged Mary and Rick Broderson, doing business as Fifth Avenue Pets in Kiron, Iowa, with violations of the Animal Welfare Act.

"Based on our investigation, we believe the Brodersons didn't meet those minimum standards and, as a result, we are charging them with numerous violations of the AWA."

APHIS charged the Brodersons for failing to:

--Maintain programs of disease control and prevention, euthanasia, and adequate veterinary care under the supervision and assistance of a doctor of veterinary medicine;

--Maintain complete records showing the acquisition, disposition, and identification of animals;

--Individually identify dogs;

--Maintain structurally sound housing facilities in good repair so as to protect the animals from injury, contain the animals securely, and restrict other animals from entering;

--Construct surfaces in housing facilities of materials and in a manner that allows them to be readily cleaned and sanitized;

-Provide dogs with sufficient space;

--Develop, document, and follow an appropriate plan to provide dogs with the opportunity to exercise;

--Feed dogs at least once a day;

--Provide dogs with potable water and keep watering receptacles for dogs clean and sanitized;

--Keep premises in good repair and clean and free of trash, junk, waste, and discarded matter;

--Sufficiently heat housing facilities to protect the animals from temperature extremes and to provide for their health and well-being;

--Provide sufficient lighting in indoor housing facilities for dogs to permit routine inspection and cleaning;

--Make provisions for the regular and frequent collection, removal, and disposal of animal and food wastes, bedding, debris, garbage, water, and other waste fluids, in a manner that minimizes contamination and disease risks; and

--Remove excreta from primary enclosures daily to prevent soiling of the dogs and to reduce disease hazards, insects, pests, and odors.
