On May 9, 2004, the defendant was arrested after a neighbor saw him strike a kitten with a shovel. The kitten tried to run away, but the defendant shoveled the kitten into a garbage can. The neighbor called the police, who found the kitten in the garbage can, struggling to get out. Unfortunately, the kitten was bleeding internally and had to be put to sleep.
Deputy County Attorney Anthony Church took this case to trial, and the defendant was found guilty of cruelty to animals, a class six felony. The defendant was sentenced to three years probation, six months jail, a $1000 fine and 360 hours of community service.
