In August 1999, the U.S. Department of Agriculture charged Dean Schocker of New Liberty, Iowa, with violations of the Animal Welfare Act.

"Schocker was apprently selling animals that he had no business selling," said W. Ron DeHaven, deputy administrator for animal care with the Animal and Plant Health Inspection Service, a part of USDA's marketing and regulatory programs mission area. "We require animal dealers to be licensed to ensure that the animals are obtained from legitimate sources and receive appropriate care under the law. We found, in this case, that proper care was not provided."

APHIS inspectors found that in addition to being unlicensed, Schocker failed to:

-Remove protrusions which could cause injury to an animal from a primary enclosure used to transport animals;

-Ensure that a primary enclosure used for the transportation of live animals had easily accessible openings for removal of an animal in case of emergency;

-Ensure that a primary enclosure used for the transportation of live animals had proper ventilation;

-Use a primary enclosure that contained sufficient space for an animal to turn about freely and make normal postural adjustments;

-Provide a sufficient quantity of material to absorb and cover excreta in a primary enclosure used to transport animals;

-Provide animals with a sufficient quantity of food and water prior to transportation; and

--Affix written food and water instructions to the outside of the primary enclosure used for transporting the live animal.
