In November 1996, the U.S. Department of Agriculture charged licensed animal dealer Daniel J. Malone, doing business as Dan's Green House in Lahaina, Hawaii, with violations of the Animal Welfare Act.

APHIS inspectors found that Malone failed to:

-- Maintain a written program of disease control and prevention, euthanasia, and adequate veterinary care under the supervision and assistance of a doctor of veterinary medicine;

-- Store supplies of food and bedding so as to adequately protect them against deterioration, molding, or contamination by vermin;

-- Establish an effective program for the control of insects, external parasites, and birds and mammals that are pests;

-- Maintain complete records showing the acquisition, disposition, and identification of animals;

-- Keep animal areas inside of housing facilities for nonhuman primates free of clutter, including equipment, furniture, and stored material;

-- Maintain surfaces of housing facilities for nonhuman rimates on a regular basis;

-- Clean and sanitize primary enclosures for nonhuman primates;

-- Individually identify dogs;

-- Develop, document, and follow an appropriate plan to provide dogs with the opportunity to exercise;

-- Provide for the removed and disposal of animal wastes so as to minimize vermin infestation, odors, and disease hazards;

-- Provide animals kept outdoors with adequate shelter from inclement weather; and

-- Construct and maintain the primary enclosure for rabbits in a manner that would allow them to stay dry.
