On October 21, 1996, the U.S. Department of Agriculture charged licensed animal dealer Barbara Coleman, doing business as Tombar Kennels in Bombay, N.Y., with violations of the Animal Welfare Act.

Dale F. Schwindaman, deputy administrator animal care with the Animal and Plant Health Inspection Service, a part of USDA's marketing and regulatory programs mission area, said that the charges against Coleman are based on APHIS inspections.

APHIS inspectors found that from 1993 through 1996, Coleman failed to:

-- Provide housing facilities for dogs that were structurally sound and maintained in good repair so as to protect the animals from injury, contain the animals securely, and restrict other animals from entering;

-- Provide for the regular and frequent disposal of animal and food wastes, bedding, debris, garbage, water, other fluids and wastes, and dead animals;

-- Provide sufficient space for dogs;

-- Use food receptacles for dogs;

-- Keep and maintain programs of disease control and prevention, euthanasia, and adequate veterinary care under the supervision and assistance of a doctor of veterinary medicine and failed to provide veterinary care to animals in need of care;

-- Keep and maintain complete records showing the acquisition, disposition, and identification of animals;

-- Individually identify dogs;

-- Equip housing facilities with disposal facilities and drainage systems so as to eliminate animal and water waste and keep the animals dry;

-- Construct floors, walls, and ceilings of indoor housing facilities and other surfaces in contact with animals of materials impervious to moisture;

-- Clean and sanitize watering receptacles for dogs;

-- Store supplies of good and bedding in a manner that protects them from spoilage, contamination, and vermin infestation;

-- Tether dogs on long enough chains to provide convenient access to the shelter structure and to food and water containers;

-- Sufficiently ventilate indoor housing facilities for dogs;

-- Provide dogs in primary enclosure with enough height space to allow each dog to stand in a comfortable position;

-- Construct enclosures in a manner that protect dogs' feet from injury and provide sufficient space to allow each animal to turn about freely;

-- Feed animals with uncontaminated, wholesome, and palatable food; and

-- Employ a sufficient number of people to carry out the level of husbandry practices and care required in maintaining animals.
