On October 26, 1996, the U.S. Department of Agriculture charged licensed animal dealer Elmer Scherbring of Earlville, Iowa, with violations of the Animal Welfare Act.

Dale F. Schwindaman, deputy administrator for animal care with the Animal and Plant Health Inspection Service, a part of USDA's marketing and regulatory programs mission area, said that the charges against Scherbring are based on APHIS inspections.

APHIS inspectors found that from 1993 through 1994 Scherbring failed to:

-- Obtain certifications for random-source dog purchases;

-- Provide certifications to buyers when selling the random-source dogs;

-- Hold random-source dogs for 5 days before delivering them to the purchaser;

-- Make and maintain accurate records of three random-source dogs that were rejected by the purchaser; and

-- Immediately identify a dog with an official identification tag.

Scherbring is also charged with falsifying his records by participating in the forgery of purported certification for at least 52 random-source dogs and reusing official identification tags.
