Herren, the dog's owner, reportedly stated that he was tired of the dog digging holes in his yard, so he shot in 3 times in the head.  Herren was arrested by Larry D. Aquirre.

A Canutillo resident accused of shooting his black Labrador retriever three times in the head for digging holes in the back yard was found not guilty by a jury in state district court today.

Jurors in the 41st District Court returned the verdict in favor of Jesus Herren after deliberating for about four hours during two days.

Herren, 60, was on trial on a charge of cruelty to animals, a state jail felony punishable by up to two years in jail and a $10,000 fine. The dog, Maggie, survived the 2005 shooting and now has new owners.

A 60 year-old man is on trial for animal cruelty. Jesus Harren is accused of shooting a black labrador retriever three times at point blank range.

Harren reportedly shot the dog for digging holes in the backyard. The incident happened in Canutillo in September of 2005. If convicted, Harren faces up to two years in state prison and a $10,000 fine, or both. The dog survived the attack and has been adopted.
