Anthony and Rebecca Kurdziel of Buffalo were charged on March 9, 2005, with one count each of cruelty to animals. SPCA special investigators removed two cats Monday, March 7, 2005, from their 7 Griswold Street home in Buffalo.
After receiving a call for assistance from Erie County Deputy Sheriff Frank Palermo, SPCA Special Agents Michael Armatys and Paul Breslin arrived at the garbage-filled home to find one three-year-old black & white cat and a two-year-old brown tiger cat, both living in unwholesome and unsanitary conditions.
The Kurdziels also face two counts each of child endangerment; their children, ages four and seven, are in the care of their grandparents. They appeared in court this morning on the child endangerment charges when issued with appearance tickets for animal cruelty charges by Armatys and Breslin. The Kurdziels are set to appear in Buffalo City Court Wednesday, March 16, 9:30 am, on those charges.
Special Agent Breslin described the Kurdziels' Griswold St. residence as having, "...an odor mixture of spoiled food, decaying garbage, soiled clothing, garbage, and assorted debris. What flooring was visible appeared to be coated in filth and grime. The kitchen area was in horrendous condition. Dirty pots, pans, dishes, and assorted other utensils were stacked in large piles, which prohibited the use of counter spaces, dining table, stove and sink. Some of the stated items were still full of rotten food and/or spoiled liquid of some kind. Within the kitchen sink besides the stack...was a black, moldy liquid. Small flying insects were abundant within this area. Various other rooms...also had stacks of dirty dishes and utensils. Used paper products were found...some of which were also still full of either decaying food and/or a spoiled liquid of some kind. One litter box was located in the first floor bathroom...and was overflowing with animal excrement."

| Buffalo City Court Judge James A.W. McLeod ruled that the Kurdziels must attend the SPCA's Animal Awareness Course, and cannot own animals for one year. Additional sentencing will take place July 26 in Buffalo City Court, 9:30 am. |
