CONVICTED: Was justice served?

Please vote on whether or not you feel the sentence in this case was appropriate for the crime. (Be sure to read the entire case and sentencing before voting.)

weak sentence = one star
strong sentence = 5 stars

more information on voting

When you vote, you are voting on whether or not the punishment fit the crime, NOT on the severity of the case itself. If you feel the sentence was very weak, you would vote 1 star. If you feel the sentence was very strong, you would vote 5 stars.

Please vote honestly and realistically. These ratings will be used a a tool for many future programs, including a "People’s Choice" of best and worst sentencing, DA and judge "report cards", and more. Try to resist the temptation to vote 1 star on every case, even if you feel that 100 years in prison isn’t enough.

County: Erie

Disposition: Convicted

Defendant/Suspect: Barbara Guay

Case Updates: 1 update(s) available

SPCA Animal Cruelty Investigator Charles Braun and SPCA Senior Investigator Michael Armatys served a search warrant at 39 Croydon Avenue at 11 am on September 23, 2005, after observing the property and acquiring the warrant late in the afternoon on Sept 22.

"The initial, anonymous complaint to Cheektowaga Housing and Neighborhood Preservation was on a 'possible cat hoarder,' and mentioned a foul odor emanating from the house," says Braun. "Upon my arrival yesterday, I could hear a small dog barking and saw from outside a number of large, exotic birds. The blinds in the picture window were covered with flies and waste, a sign of unsanitary conditions. There were a number of other large dogs on the back porch, which was littered with trash and waste. I knew we needed to get in there."

At the time of this writing, Braun was on the scene and was reportedly seizing at least 17 exotic birds, more than 13 dogs, and numerous cats, rabbits and other small animals including a hamster. He says the conditions inside are much worse than originally thought, and that the entire one-family dwelling is filled with, "...wall-to-wall feces and garbage." All of the animals will be transported to the SPCA for veterinary observation and necessary care. They have all been surrendered by Guay to the SPCA.

Also on the scene this morning were members of the Cheektowaga Police, Fire Department, and Animal Control, Cheektowaga Housing and Neighborhood Preservation, and the Cheektowaga Building Inspector.

Animal owner Barbara M. Guay has been charged by Braun with cruelty to animals, and will be arraigned September 29, 8:30 am in Cheektowaga Town Court.

Case Updates

Barb Guay pleaded guilty in town court to a misdemeanor charge of animal cruelty. She must now attend counseling at the SPCA. In September, rescuers found more than a dozen dogs, 17 exotic birds, and numerous other small animals living in terrible conditions in her Croydon Street Home.

Note: Classifications and other fields should not be used to determine what specific charges the suspect is facing or was convicted of - they are for research and statistical purposes only. The case report and subsequent updates outline the specific charges. Charges referenced in the original case report may be modified throughout the course of the investigation or trial, so case updates, when available, should always be considered the most accurate reflection of charges.
