Dog kicked, beaten with wooden plank Lowell, MA (US)Incident Date: Saturday, Mar 31, 1990 County: Middlesex
Disposition: Convicted
Defendant/Suspect: Kevin Deschene
Kevin Deschene, a 34-year-old Lowell man, was convicted on Sept 15, 2005 on a lewdness charge after he was accused of accosting a 12-year-old girl who was walking along Powell Street on April 13, 2002.
A postal worker reported the incident to a Lowell police officer, who caught Deschene in his car with his pants down masturbating in the April 13, 2002 incident, according to court documents.
An officer who responded to the scene found Deschene's car parked on Powell Street. When confronted by the officer, Deschene allegedly jumped out of the car and fled toward a nearby restaurant. The officer was able to tackle Deschene in the restaurant's kitchen.
Following a four-day trial, a Lowell Superior Court jury found Deschene guilty of open and gross, lewd and lascivious behavior, and resisting arrest.
Deschene faces up to three years in state prison for the lewdness charge, but it won't be his first time behind bars.
One of his past convictions was in 1990 when Deschene, then a teenager, made headlines after a neighbor snapped photographs of Deschene's dog "Champ," hunched down and snarling as Deschene lifted his leg and a wooden plank to the animal.
The story was slashed across People magazine, television news-magazine shows and major newspapers across the country.
He spent six months in jail for animal cruelty, but received a much lighter sentence eight years later when he was convicted of battery on another person.
Deschene was sentenced to five years probation after he was found guilty of two counts of assault and battery with a dangerous weapon, and one count of assault and battery, in connection with a Nov. 9, 1996 assault outside Gus and Paul's Bar in Lowell.
However, Deschene's probation was violated after his arrest in October 2002, and he is currently serving a five-year state prison sentence. His sentencing hearing for the lewdness charge is set for Sept. 28. References« MA State Animal Cruelty Map « More cases in Middlesex County, MA
