McKenny reportedly took the dog named Baxter to the veterinarian to have him euthanized, stating that he "bit someone."
McKenny and the veterinarian made the decision to euthanize the dog. This was in direct violation of the contractual commitment entered into by Ms. McKenny with the shelter from which she was in the process of adopting Baxter. This adoption was not yet finalized because all contractual terms had not been satisfied, e.g., a home visit. Ms. McKenny had begun the adoption process just one week earlier.
During that week, the shelter president had attempted to get the dog back. Ms. McKenny refused, saying that the dog was fine with her. She had a contractual obligation to return the dog to the shelter, but instead had him euthanized.
On November 30, 2004, Ms. McKenny pleaded guilty to "Needless killing of a living animal." She was fined $250.00 plus court cost of $33.00, and another charge was dropped. References- Court docket #:ZZA 2004 4474
